Waiver & Release of Liability

I, the student, or the parent/legal guardian on behalf of the student (herein referred to as "the Student", "me" or "I"), understand that under the terms of this agreement, Jiu-Jitsu Modern Incorporated ("JJMDRN”) obligates itself to furnish me with competent instruction and suitable facilities for teaching lessons. All class lessons are supervised by qualified personnel trained in the procedures and traditions of the Martial Arts as expressed by the JJMDRN. The student hereby represents that the Student is physically fit to receive and participate in the prescribed course of instruction. The Student agrees to faithfully comply with all the rules and regulations of JJMDRN. I, the Student, understand that if my tuition is arranged to be made in monthly installments to JJMDRN. Any modifications, changes, amendments, or cancellations to this Student Enrollment Agreement must be in writing. No oral amendments or modifications are to be made to the Student Enrollment Agreement. I further understand that failure to complete the training does not relieve me of my obligation to pay the tuition in full. The budgeted tuition payment plan is not affected by my training schedule and/or attendance. JJMDRN  may fully assign its rights and obligations under the agreement at its Sole Discretion after providing me with notice.  I, the student, agree to receive and participate in, and the JJMDRN agrees to teach, a course of Martial Arts instruction, the program goal being a Black Belt, in Jiu-Jitsu. Notwithstanding the foregoing, I understand that there is no guaranty that I will be awarded a Black Belt, or any other rank, in Jiu-Jitsu and related arts by JJMDRN. I recognize that the awarding of any rank to me is at JJMDRN’s sole discretion and is not contingent upon any tuition, or fees, paid to JJMDRN.I hereby consent to the JJMDRN taking photographs or video image of me while in classes or otherwise in the public premises of the JJMDRN and hereby irrevocably grant the right to use my image or likeness in such images or photographs in any advertising, promotion, marketing materials including any social media, print media, or on the website.Membership includes only the class program/s you signed up for. Students in the Basics program cannot go to any Advance classes without JJMDRN’s permission. Child Students must only take classes in their age program unless having the permission of JJMDRN. Basics classes starts at age 16, or earlier with consent of JJMDRN and Parent.JJMDRN reserves the right to alter the days and/or hours of operation, the curriculum, and the number of classes you're entitled to attend if deemed necessary.Any missed child classes must be made up within 1 month of the classes originally missed.Family discount: Any family discount will be retracted if the accompanying family member/s are no longer active members of JJMDRN.Both Child and Adult memberships are revolving (on-going). Memberships can be terminated with 60-days notice. Email cancel request to tara.jiujitsumodern@gmail.com. Fill out and return appropriate paperwork to JJMDRN. You have the right to freeze this agreement for no more than two (2) months per year. You will need to fill out a freeze form and give 30-days' notice. The freeze will start 30 days after paperwork is completed and returned to JJMDRN. Email Freeze request to tara.jiujitsumodern@gmail.com. Fill out and return appropriate paperwork to JJMDRN. Injury Waiver The student, the parent, or the legal guardian on behalf of the student, acknowledges, and is fully cognizant, of all the inherent dangers in connection with Martial Arts training and acknowledges that training in Martial Arts requires physical exertion and contact, and carries a risk of serious physical injury which may be incurred while engaged in this activity. The student, the parent, or legal guardian on behalf of the student, hereby waives any claims for any physical injury in connection with the training at JJMDRN and expressly assumes the risk of all dangers or injury inherent to the Martial Arts or stemming therefrom.  I warrant and represent that I and/or the child I am the guardian of is in the appropriate physical condition for the physical activities in which I/he/she will participate and that such physical activates, even non-contact activities, carry a risk of serious injury including substantial permanent injuries, and/or death. I knowingly and voluntarily assume all risks described above, and I will waive in advance any claim or liability resulting from those risks. I acknowledge and agree (1) that it is my responsibility to cover any medical bills that I may incur and to cover myself with any medical insurance I may deem appropriate and (2) that I will not and cannot make any claim for medical coverage or civil liabilities as a result from any injury or death incurred by me at the facilities of JJMDRN. I am aware that previous injuries and/or surgeries may put me even at higher risk for injury in this contact sport.JJMDRN has put in place preventative measures to reduce the spread of contagious illnesses; however, JJMDRN cannot guarantee that you or your child(ren) will not become infected with a contagious illness. JJMDRN reserves the right to cancel this membership at any time for any reason to protect its staff, students, and/or business.
